Terms of use for the application operated by the Federal Roads Office (FEDRO) for checking the validity of electronic provisional driving licences (ePDL)

1. Scope and Purpose
1.1. These terms of use govern the acquisition and use of the LicenceCheck web application by users and are deemed to be an integral part thereof. In addition to these terms of use, the privacy statement of the LicenceCheck web application and the terms of use and privacy statement of the application for the storage and presentation of digital credentials from the federal trust infrastructure (swiyu Wallet) must also be observed.
1.2. The sole purpose of the LicenceCheck web application and the associated data processing is to check the validity of the electronic provisional driving licences presented by users.
2. Conditions of use and access conditions
2.1. The LicenceCheck web application can be used on internet-enabled devices.
2.2. The use of the LicenceCheck web application is not restricted to a geographical region.
2.3. By using the LicenceCheck web application, those using the web app (hereinafter referred to as verifiers) declare that they have understood and acknowledge the following conditions and legal information in connection with the LicenceCheck web application (and the elements contained therein). Upon opening the LicenceCheck web application, verifiers must agree to these conditions. Verifiers who do not agree to these conditions will be unable to use the LicenceCheck web application.
3. Functions of the app
Verifiers can use the LicenceCheck web application to check the validity of an ePDL presented to them. Verification can only be performed physically between the swiyu Wallet and the LicenceCheck web application. Specifically, the LicenceCheck web application provides for the following processing steps:
3.1. To check an ePDL, the verifier generates a request in the LicenceCheck web application using a QR code. No personal data is transmitted at this stage. The verifier can choose to check only the validity of the ePDL or to check all data:
- Check validity: the ePDL is checked solely in terms of its validity. The photo, expiry date, licence category and any restrictions and conditions are displayed. If the ePDL is not valid, only the status «invalid» is displayed.
- Check all data: the verifier retrieves all data relating to the ePDL holder. This includes the following data: Photo, full name, date of birth, place of origin, signature, ePDL issue and expiry date, issuing authority, provisional driving licence number, FABER PIN, licence category, category pictogram, any additional category details, restrictions, conditions and a QR code for police checks. If the ePDL is not valid, only the status «invalid» is displayed, without any further personal data being transmitted.
3.2. The verifier then receives a QR code from the LicenceCheck web application.
3.3. The holder of the ePDL now has to use the swiyu Wallet to scan the QR code on the verifier's device. They need to allow the swiyu Wallet to use the camera to do this.
3.4. The holder of the ePDL then receives the verification request in the swiyu Wallet and can see which data is being requested by the verifier.
3.5. The holder of the ePDL can decide whether to submit the requested information or decline the request.
3.6. If the request is accepted, the requested information is sent to the LicenceCheck web application and thus to the verifier. If the request is declined, the verifier is informed that it has been declined.
3.7. By using the LicenceCheck web application, users accept the terms and conditions, and acknowledge the federal government's general privacy notice (Terms and conditions (admin.ch)) and the privacy statement of the LicenceCheck web application.
The LicenceCheck web application does not use location tracking or geolocalisation.
4. Verifiers' duties of care
4.1. Users are responsible for technical access to the LicenceCheck web application.
4.2. Users are responsible for taking the necessary security precautions for their own devices.
4.3. Users are responsible for ensuring compliance with the applicable legal provisions and the terms of use when using the LicenceCheck web application.
5. Liability and warranty
5.1. Although FEDRO, the FOITT and the Swiss Confederation take all reasonable care to ensure that the information, content and notifications published in the LicenceCheck web application are correct, no warranty can be given with regard to their correctness, accuracy, timeliness, reliability and completeness. FEDRO and the FOITT have neither control over nor knowledge of the digital credentials displayed using the LicenceCheck web application and their content.
5.2. FEDRO and the FOITT expressly reserve the right, without prior notice and at any time, to change or delete some or all LicenceCheck web application information and content, or to temporarily withhold publication of such information and content.
5.3. Any liability claims against FEDRO, the FOITT or the Swiss Confederation for material or immaterial damages, including consequential damages, which may arise from access to, use or non-use of the LicenceCheck web application and its information, content and notifications, from misuse of the connection, from technical faults or from the breach of the users' duties of care, for example, are excluded to the extent permitted by law.
5.4. The user shall be responsible for and assume the risk of any action or conduct based on the information, content and notifications of the app. FEDRO, the FOITT and the Swiss Confederation accept no liability whatsoever for any resulting damage.
5.5. Liability for associates and third parties is excluded to the extent permitted by law.
5.6. FEDRO, the FOITT and the Swiss Confederation assume no responsibility and give no guarantee that the functions and use of the LicenceCheck web application will be available continuously and uninterruptedly, that they will be free of errors and malfunctions, that errors will be rectified or that the servers are free of viruses or other harmful components.
FEDRO is entitled to interrupt or discontinue the use of the LicenceCheck web application at any time.
5.7. FEDRO, the FOITT and the Swiss Confederation are not responsible for references and links to third-party websites. FEDRO accepts no liability for the existence, content or accuracy of this information. Users who access and/or use such websites do so at their own risk. FEDRO explicitly declares that it has no influence whatsoever on the design, content or offerings of linked sites. The relevant third party is entirely responsible for the information and services of linked third-party websites. Any responsibility in respect of such websites is declined.
6. Data Protection
The processing of personal data by FEDRO is governed by the privacy statement of the LicenceCheck web application and the legal basis mentioned therein.
7. Copyright, property rights and rights of use
7.1. The source code of the LicenceCheck web application provided by FEDRO and developed by the FOITT is published, unless the rights of third parties or security-related reasons would exclude or restrict this .
7.2. The content within the LicenceCheck web application is protected by copyright. Any reproduction or transmission of the app content to third parties is prohibited. Downloading or copying content, illustrations, photos or any other data does not entail any transfer of rights concerning the content.
7.3. Copyright and all other rights to content, illustrations, photos or other LicenceCheck web application data belong exclusively to FEDRO, the FOITT and/or the Swiss Confederation, or to any specifically named rights holders. The reproduction of any components requires the prior written consent of the copyright holder.
8. Final provisions
8.1. These provisions have been drawn up in several languages. In the event of any discrepancies, the German version will prevail.
8.2. Use of the LicenceCheck web application is free of charge for users. Any costs for network access in order to use the app are borne by the user.
8.3. FEDRO reserves the right to amend and supplement the terms of use at any time. Users will be notified of the new conditions in advance in an appropriate manner and will be deemed to have accepted them if they continue to use the LicenceCheck web application.
8.4. Should a provision of the terms of use be void or ineffective, this shall not affect the terms of use in general.
8.5. Swiss law is applicable. The place of jurisdiction for all disputes is the competent Swiss court.
Privacy statement concerning the application operated by the Federal Roads Office (FEDRO) for checking the validity of electronic provisional driving licences (ePDL)

1. Introduction
In this privacy statement, the Federal Roads Office (FEDRO) explains to what extent and under what conditions it processes personal data with regard to the use of the web application for checking the validity of electronic provisional driving licences (hereinafter "LicenceCheck"). In addition to this privacy statement and the associated data protection conditions, the terms of use of the application for the storage and presentation of digital credentials from the federal trust infrastructure (swiyu Wallet) must also be observed.
The processing of personal data by the Federal Administration is governed by Swiss data protection law. It applies to data processing in connection with the LicenceCheck web application. Data processing by FEDRO is based on the Road Traffic Act of 19 December 1958 (RTA; SR 741.01), the Ordinance of 27 October 1976 on the Authorisation of Persons and Vehicles for Road Traffic Purposes (RTAO; SR 741.51), the directives concerning the electronic provisional driving licence pilot project in accordance with Article 150 paragraph 2 letter a and paragraph 6 of the RTAO and the Ordinance of 30 November 2018 on the Driver and Vehicle Authorisation Information System (DVAISO; SR 741.58).

3. Data processing
FEDRO provides the LicenceCheck web application, which can be used on internet-enabled devices and is designed for electronically checking the validity of electronic provisional driving licences. For this purpose, the IP address is processed on federal servers in Switzerland. The installation and use of the LicenceCheck web application are voluntary.
Specifically, the LicenceCheck web application provides for the following processing steps:
1. To check the authenticity, integrity, validity and conformity of an electronic provisional driving licence, the person verifying (verifier) must create a request in the LicenceCheck web application. They can choose between a minimum and a maximum variant:
- Check validity: the ePDL is checked solely in terms of its validity. The photo, expiry date, licence category and any restrictions and conditions are displayed. If the ePDL is not valid, only the status «invalid» is displayed.
- Check all data: the verifier retrieves all data relating to the ePDL holder. This includes the following data: Photo, full name, date of birth, place of origin, signature, ePDL issue and expiry date, issuing authority, provisional driving licence number, FABER PIN, licence category, category pictogram, any additional category details, restrictions, conditions and a QR code for police checks. If the ePDL is not valid, only the status “invalid” is displayed, without any further personal data being transmitted.
2. The verifier then receives a QR code.
3. The holder of the ePDL now has to use the swiyu Wallet to scan the QR code on the verifier's device.
4. The holder of the ePDL then receives the verification request in the swiyu Wallet and can see which data is being requested by the verifier, i.e. whether it is all data or just a validity check.
5. The holder of the ePDL can accept or decline the request.
6. If the request is accepted, the relevant data is sent to the LicenceCheck web application and thus to the verifier. If the request is declined, the verifier is only informed that it has been declined.
Verification can only be performed physically between the swiyu Wallet and the LicenceCheck web application.
The LicenceCheck web application is designed in accordance with the principle of data minimisation. This means that the verifier only obtains the specified ePDL information that is required in the context of their checking duties.
4. Data Storage
Your personal data will only be stored to the extent and for as long as necessary to fulfil the purposes described in this privacy policy or to comply with legal obligations.
Moreover, the information is displayed to verifiers only until they exit the corresponding view in the app (e.g. until they check a different ePDL). The information is deleted again immediately afterwards. No personal data is stored permanently in the LicenceCheck web application. The verifier's IP address is temporarily stored at the Federal Office of Information Technology, Systems and Telecommunication (FOITT) for both verification variants. The LicenceCheck web application does not use location tracking or geolocalisation.
5. Purpose
The sole purpose of the LicenceCheck web application and the associated data processing is to check the validity of the ePDLs presented by users.
6. Data security
In order to protect the data against unauthorised access, loss and misuse, FEDRO and the FOITT take appropriate security measures. In particular, facilities access controls, data access controls and procedures for regularly reviewing, assessing and evaluating the effectiveness of the measures are implemented in accordance with a risk assessment.
7. Further information
The source code of the LicenceCheck web application provided by FEDRO and developed by the FOITT is published.
FEDRO and the FOITT use cookies, tags and similar technologies in the web application to provide the best possible user experience and to improve the web application. Cookies are text files that are downloaded to the user's computer or mobile device when the LicenceCheck web application is used.
Some of the cookies used are necessary to provide certain web application functions. In addition, cookies are used to analyse usage and to gather information for optimisation purposes. Users can instruct their browser not to accept cookies or to allow the use of cookies only with the user's consent. In addition, users can delete cookies from devices by using the corresponding function of their browser.
8. Amendments
This privacy statement may be amended by FEDRO at any time without prior notice. The published version or the version valid for the period in question shall apply.
9. Data transfer
In order to achieve the purposes described in this privacy statement, it may be necessary for your personal data to be passed on to third parties. The categories of recipients are as follows:
