pilotWallet terms of use
Application for the storage and presentation of digital credentials from the federal trust infrastructure (hereinafter "pilotWallet")
1. Scope and purpose
1.1. These terms of use govern the acquisition and use of the pilotWallet app by users and are deemed to be an integral part thereof.
1.2. The purpose of pilotWallet is to enable users to securely store and transfer digital credentials issued within the framework of the Swiss trust infrastructure (verifiable credentials). The app also offers a function that allows users to transfer selected information from verifiable credentials to the requester when information is requested.
2. Conditions of use and access conditions
2.1. The installation of pilotWallet on mobile phones and its use are voluntary for users.
2.2. The use of pilotWallet is not restricted to a geographical region.
2.3. By accessing pilotWallet, users declare that they have understood and acknowledge the following conditions and legal information in connection with pilotWallet (and the elements contained therein). Users who do not agree to these conditions must refrain from using pilotWallet.
3. Functions of the app
3.1. Users can use pilotWallet to store and manage verifiable digital credentials and present them in connection with verification requests.
3.2. Digital credentials can be received in the following two ways by activating a deep link:
3.2.1. By scanning a QR code with a mobile phone. pilotWallet must be allowed to use the camera to do this.
3.2.2. By clicking on the link on a mobile phone.
3.3. pilotWallet performs the following functions via an interface to the operating system of the user's mobile phone:
pilotWallet can be used to receive credentials from the federal trust infrastructure digitally and in encrypted format; Verifiable digital credentials can be imported into pilotWallet using a deep link; a QR code can also be used to scan the deep link using the camera; Stored digital credentials can be transmitted to a verifier system for verification; The validity and revocation status of stored credentials can be checked in pilotWallet; pilotWallet offers users the option of querying how many times a digital credential has already been verified and when.
3.4. pilotWallet does not use location tracking or geopositioning.
4. Users' duties of care
4.1. Users are responsible for technical access to pilotWallet.
4.2. Users are obliged to take the necessary security precautions for their own devices in order to protect credentials against unauthorised access by third parties and against malware.
Users' attention is hereby drawn to possible security risks arising from the use of the internet and internet technologies.
4.3. Users are obliged to keep pilotWallet up to date and to apply updates. The FOITT may take technical precautions to ensure version enforcement. There is no entitlement to use a specific software version.
4.6. Users are responsible for ensuring compliance with the applicable legal provisions and the terms of use when using pilotWallet.
5. Liability and warranty
5.1. Although the FOITT and the Swiss Confederation take all reasonable care to ensure that the information, content and notifications published in pilotWallet are correct, no warranty can be given with regard to their correctness, accuracy, timeliness, reliability and completeness. The FOITT has neither control over nor knowledge of the digital credentials displayed using pilotWallet and their content.
5.2. The FOITT expressly reserves the right, without prior notice and at any time, to change or delete some or all pilotWallet information and content, or to temporarily withhold publication of such information and content.
5.2. Any liability claims against the FOITT or the Swiss Confederation for material or immaterial damages, including consequential damages, which may arise from access to, use or non-use of pilotWallet and its information, content and notifications, from misuse of the connection, from technical faults or from the breach of the users' duties of care, for example, are excluded to the extent permitted by law.
The user shall be responsible for and assume the risk of any action or conduct based on the information, content and notifications of the app. The FOITT and the Swiss Confederation accept no liability whatsoever for any resulting damage.
5.3. Liability for associates and third parties is excluded to the extent permitted by law.
5.4. The FOITT and the Swiss Confederation assume no responsibility and give no guarantee that the functions and use of pilotWallet will be available continuously and uninterruptedly, that they will be free of errors and malfunctions, that errors will be rectified or that the servers are free of viruses or other harmful components.
The FOITT and the Swiss Confederation are authorised to interrupt or discontinue the use of pilotWallet at any time until the Federal Act on Electronic Identity Credentials and Other Electronic Credentials (e-ID Act) comes into force.
5.5. The FOITT is not responsible for references and links to third-party websites. The FOITT accepts no liability for the existence, content or accuracy of this information. Users who access and/or use such websites do so at their own risk. The FOITT explicitly declares that it has no influence whatsoever on the design, content or offerings of linked sites. The relevant third party is entirely responsible for the information and services of linked third-party websites.
Any responsibility in respect of such websites is declined.
6. Data protection
6.1. The processing of personal data by the FOITT is governed by the pilotWallet privacy statement.
7. Termination of use
7.1. pilotWallet use may be terminated by the user at any time by deleting/uninstalling the app on the mobile phone.
8. Copyright, property rights and rights of use
8.1. The open-source app code is made available by the FOITT in accordance with Article 9 of the Federal Act on the Use of Electronic Means to Carry Out Official Tasks (EMOTA).
8.2. The pilotWallet content, with the exception of the credentials and the source code (see section 8.1), is protected by copyright. Any reproduction or transmission of the app content to third parties is prohibited. Downloading or copying content, illustrations, photos or any other data does not entail any transfer of rights concerning the content.
Copyright and all other rights to content, illustrations, photos or other pilotWallet data belong exclusively to the FOITT or to any specifically named rights holders. The reproduction of any components requires the prior written consent of the copyright holder.
9. Final provisions
9.1. These provisions have been drawn up in several languages. In the event of any discrepancies, the German version will prevail.
9.2. pilotWallet use is free of charge for users. Any costs for network access in order to use the app are borne by the user.
9.3. The FOITT reserves the right to amend and supplement the terms of use at any time. Users will be notified of the new conditions in advance in an appropriate manner and will be deemed to have accepted them if they continue to use pilotWallet.
9.4. Should a provision of the terms of use be void or ineffective, this shall not affect the terms of use in general.
9.5. Swiss law is applicable, unless mandatory provisions state otherwise. The place of jurisdiction for all disputes is the competent Swiss court.
